ACKNOWLEDGEMENT AND ACCEPTANCE OF THE TERMS OF SERVICE
The term "Quin Design" or "us" or "we" refers to the owner of the website; whose registered office is 13310 34th Ave N, Plymouth, MN 55441 and registered business name is "Quintessential Design, LLC." The term "you" refers to the user or viewer of our website.
This site is created and controlled by Quin Design, and it reserves the right to make changes to the website and the terms, conditions and disclaimers at any time and without information to the customers/users of the services/website of Quin Design
" Quin Design “/ "website” means the online shopping platform and the services provided by it and its affiliates owned and operated by Quin Design
"Product/s" means the goods, services promoted / displayed on the website and offered for any use / sale.
"Customer" / "buyer” shall mean the person or any legal entity who accepts the offer for sale on Quin Design by placing an order for and purchases any product offered for sale on this website.
"User" / "you" means and includes any person or any legal entity using or accessing the services provided on this website.
User consents to receiving communications from Quin Design electronically. Quin Design will communicate with you by e-mail or by posting notices on this website.
Quin Design expressly disclaims any warranties or representations express or implied in respect of quality, safety, merchantability, fitness for a particular purpose, or legality of the products listed and transacted on Quin Design websites.
You further agree and undertake that you are accessing the services available on this website and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site.
Quin Design is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of items, which are out of stock, back ordered, returned undelivered or otherwise unavailable. All items are offered only for a restricted time and only for the available supply/till stock lasts.
Quin Design accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
All orders shall be pre-approved with an acceptable method of payment as established by Quin Design which may call for and require additional verification or information.
The address at which delivery of the product/s ordered by you is/are to be made should be correct and proper in all respects
After the receipt of payment from you, we shall arrange for the delivery of the product at the shipping address provided by you.
Any and all orders placed by you on this website are a firm commitment to purchase and you are obligated to complete the transaction and not contest it in anyway.
Before placing an order you are advised to check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description.
All prices, unless indicated otherwise are in US Dollars.
ELIGIBILITY AND REGISTRATION
The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.
Quin Design reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
User of Quin Ride App is required to register. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, the User agrees not to use any other party's user ID and Password for any purpose whatsoever without proper authorization from such party.
User is responsible for the security of User’s password and for all transactions undertaken using User’s password through our service. User confirms that he/she is the authorized holder of the credit card or the original account holder used in the transactions under this website. Quin Design will not be responsible for any financial loss or inconvenience resulting from misuse of user’s ID/password/credit card number/account details for using Quin Design websites.
The user also agrees and undertakes to immediately notify Quin Design of any unauthorized use of the user's password or user ID and to ensure that the user logs off at the end of each session at the website. Quin Design shall not be responsible for any, direct or indirect, loss or damage arising out of the user's failure to comply with this requirement.
As a part of registration process you agree to provide Quin Design current, complete, and accurate information as prompted to do by the Service and to maintain and update this information as required keeping it current, complete and accurate.
If you provide any information that is untrue, inaccurate not current or incomplete or Quin Design has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Quin Design has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the website.
CREDIT CARD DETAILS
You understand, you agree and you confirm that the credit card details provided by you for availing the services on Quin Design are correct and accurate and you shall not use the credit card which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit card details to Quin Design.
SUSPENSION DUE TO NON-COMPLIANCE WITH AGREEMENT
Notwithstanding other legal remedies that may be available to Quin Design may in its sole discretion limit user activity by immediately removing user listing either temporarily or indefinitely or suspend or terminate user membership, and/or refuse to provide user with access to the site if:
The user is in breach any of the terms and conditions of this agreement and/or the terms and conditions of usage of Quin Design. The user has provided wrong, inaccurate, incomplete or incorrect information;. Your actions may cause any harm, damage or loss to the other Users or Quin Design.
Illegal and/or unauthorized use of the service, including unauthorized framing of or linking to the Quin Design sites will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.
You agree to indemnify, defend, and hold harmless Quin Design, its affiliates, and all of their employees, agents, officers, directors, proprietors, partners, representatives, shareholders, servants, attorneys, accountants, predecessors, successors, and assigns from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and litigation expenses) relating to or arising from your use of this site or any breach by you of these Terms and Conditions.
This clause shall survive the expiry or termination of this Agreement.
DISCLAIMER OF WARRANTIES/LIMITATION OF LIABILITY
"We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time"
Quin Design shows final price to the customer. Any seller or the party selling goods on our website is to pay sales taxes in their own state as per product taxes Applicable.
RISK OF LOSS
The risk of loss and title for items purchased by you pass to you upon Quin Design delivery of the items to the carrier pursuant to Quin Design standard terms of sale.
Quin Design shall have no liability to you for any interruption or delay in access to the website irrespective of the cause.

This Privacy Statement describes the steps we take to secure your data and our practices as required by data protection laws. It applies where Quin Design is controlling the purposes and means of processing your personal data.

INFORMATION COLLECTION AND USE
Quin Design, LLC and its affiliates, is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

provide the Automatic Data Collection Tools and Services;
monitor and analyse use of the Site or Services, for the technical administration of the Site or Services, and to increase functionality and user-friendliness, and to better tailor our Site or Services, to the needs of Quin Users;

to evaluate and improve your riding experience;
to help you maintain your helmet;
to offer you opportunities and promotions that Quin believes would be of benefit to you;
respond to your comments and questions and to provide customer service;

maintain internal research and other marketing purposes, including e-mailing you with special promotions, other programs of interest and other news, including information about products and services offered by us and our affiliates, provided you have opted-in to receive such information. If the information is sent as part of a website evaluation, Quin may also use the information to contact you about your comments;
to prevent fraud or misuse;
to help protect the safety of other Quin Users;
to comply with legal requirements;
for related legitimate purposes as permitted by applicable law; or
as described in the “Sharing of Personal Data” section below.
Sharing of Personal Data
Quin will only share your personal information with third parties:
with your consent;
if Quin determines that it is required to do so by law; such as in response to a court order or subpoena;
if Quin finds that you are in breach of its terms and conditions or any of its policies or usage guidelines for specific products or services;
if it is necessary in Quin’s opinion to do so to prevent, investigate, detect or prosecute criminal offences or attacks on the technical integrity of the Site or Quin network;
if it is necessary in Quin’s opinion to do so to protect the rights, property, or safety of Quin or its employees, Quin Users, or the public;
if it is necessary to fulfil your product or service order. Quin uses a credit card processing company to process your credit card information as required for your order and to ensure that your transaction is secure. This processing company does not retain, share, store or use your personally identifiable information for any other purposes;
who provide services such as data analysis payment processing, information technology and related infrastructure provision, customer service, email delivery, auditing and for other similar legitimate purposes permitted by applicable law;
such as third party advertisers and advertising networks that require the data to select and serve relevant adverts to you and others; or
when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.
We request information from the user on our order form. Here a user must provide contact information (like name and shipping address). This information is used for billing purposes and to fulfill customer's orders. If we have trouble processing an order, this contact information is used to get in touch with the user.
INFORMATION FROM SOCIAL MEDIA CONNECTIONS
You may choose to enable or log in to Quin via various social media or social networking services such as Facebook or Twitter (“Social Networking Services”). When you connect your Account to a social media account, we collect certain personal information that you have provided to that Social Networking Service. For example, when you log in with your Facebook credentials, we may collect personal information from your Facebook profile, such as your email address, profile picture, and friend list.
Information Automatically Collected. When you access or use the Site, as a Registered Member or a non-registered user just browsing (any of these, a “Quin User”), we and third parties that provide certain functionality on our Site, such as Facebook, Twitter, and ad networks, may engage, receive, collect, and store certain types of information through automatic data collection tools including cookies, pixel tags, Web beacons, embedded Web links, and other commonly used information gathering tools (“Automatic Data Collection Tools”). These Automatic Data Collection Tools collect certain information including, but not limited to, information such as your web requests, Internet Protocol address, browser type, browser language, the date and time of your request, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, cookies that may uniquely identify your browser, and elements employed in the Mobile Applications. Quin may use your IP address to identify you, to administer the Site and to assist in diagnosing problems with Quin’s server. Quin may also uses Google Analytics to track statistics and user behaviour on the Site.
We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.
We will share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person. We use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. We partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services.
These parties are not allowed to use personally identifiable information except for the purpose of providing these services.
This web site contains links to other sites. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by this website.
If a user wishes to subscribe to our newsletter, we ask for contact information such as name and e-mail address.
SURVEY AND CONTESTS
From time-to-time our site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). The importance of security for all personally identifiable information associated with our Guests is of utmost concern. We exercise great care in providing secure transmission of your information from your PC to our servers, utilizing encryption software. Only those employees who need access to your information in order to do their jobs are allowed access, each having signed compressive nondisclosure agreements, which provides explicit legal confidentiality protections. Any employee who violates our privacy and/or security policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution.
We send all new members a welcoming e-mail to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications.
SITE AND SERVICE UPDATES
We also send the user site and service announcement updates. Members are not able to un-subscribe from service announcements, which contain important information about the service. We communicate with the user to provide requested services and in regards to issues relating to their account via e-mail or phone.
CORRECTION/UPDATING PERSONAL INFORMATION
If a user's personally identifiable information changes (such as your zip code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us. This can usually be done at the member information page or by e-mailing our Customer Support.
Our users are given the opportunity to 'opt-out' of having their information used for purposes not directly related to our site at the point where we ask for the information. For example, our order form has an 'opt-out' mechanism so users who buy a product from us, but don't want any marketing material, can keep their e-mail address off of our lists. Users who no longer wish to receive our newsletter or promotional materials from our partners may opt-out of receiving these communications.
ACCEPTANCE OF THESE TERMS
All sales are final and non-refundable. Exchanges are possible only in the case that a helmet does not fit. All returns for exchange or refund must be returned within 10 days from receipt date, and must be new, unused, and unaltered and include original product packaging including tags.
Contact us at email@example.com within 10 days from the date your package arrives for your Return Merchandise Authorization (RMA)
Return all RMA items via ground shipping to the address provided with your RMA#.
Note: Exchanges must be in new condition and include original product packaging, labels and tags. The Manufacturer's packaging must be clear of writings or markings. Do not use the manufacturer's product box as the shipping container. Customers are responsible for related shipping fees during the exchange process.
Before sending any item(s), you must email to get prior authorization before returning any item, regardless of reason, to request a Return Merchandise Authorization (RMA).
Quin Design cannot accept returned merchandise without an RMA. The RMA number should be written on the shipping label or visible on the shipping box.
Please note that third-party shippers, such as UPS Store, FedEx Kinko's, Mailbox Etc., and similar companies, may add charges to normal ground shipping costs. Quin Design does not reimburse these charges. Do not return any items COD; our returns department cannot accept COD returns.
Parts that have been installed (or damaged while attempting to install) and/or used in any manner will not be accepted for return.
All closeout and clearance merchandise sales are final and cannot be refunded. Exchanges or manufacturers defect are not acceptable.
If Quin is unable to delivery on pre-ordered products for any reason (including but not limited to manufacturing delays, model availability, force majeure, etc.), customers will be entitled to choose from existing available stock as a replacement.
WARRANTY AND RETURNS
QUIN ONLINE STORE RETURN POLICY
Please do not return an item for exchange without getting a Return Merchandise Authorization (RMA) number. Quin cannot accept merchandise without an RMA. To get an RMA number, please send us an e-mail at firstname.lastname@example.org stating your order number and date of purchase.
To exchange an item you must contact us within 10 days from the date your package arrives. Quin is not responsible for any damage or loss of returned packages and we suggest that you insure the returned package(s) through the carrier and obtain and keep your tracking number until your refund has been processed.
Returns for exchange must be in new condition and include all original tags product packaging.
The packaging must be clear of writings or markings.
Return shipping costs and other incidental fees are the sole responsibility of the customer unless the item was defective or shipped in error – in which case, Quin will provide a call tag for the return.
Quin warrants that all our products are fit for their intended use and free of manufacturing defects in material or faults due to poor workmanship. If you experience that your product is delivered with, or has developed a fault, please email us before returning any goods in order to avoid unnecessary postage fees. If your warranty is handled locally by our distributors, we will refer you to the concerned entity.

FULL WARRANTY POLICY
Quin warrants that the products are free of manufacturing defects in material and workmanship when it is delivered to our dealers. This warranty is limited to one year from the date of purchase and is limited to the original purchaser.
The warranty does not apply in the event of abuse, neglect, carelessness, using the product in any way other than is intended, replacement with any part or accessory other than original Quin parts and products, attempt of reparation or modification unless expressly permitted in writing by Quin.
Corrosion and deterioration caused by material fatigue after extended use is not covered by the warranty.
Proof of purchase is required with all potential warranty claims.
This warranty takes precedence over any other agreements or warranties, general or special, expressed or implied and no representative or person is authorized to assume liability on behalf of Quin in connection with the sale or use of this product.
Quin makes no other expressed warranties or guarantees, except as otherwise specifically stated.
Quin waives all responsibility for any third party for consequences that might result from the use or handling of any Quin product by any legal or natural person.
Quin may utilize user data collected in the Quin App to determine validity of a claim for exchange, warranty or replacement.
IMPORTANT WARRANTY NOTICE: Quin warrants to customers only new helmets purchased from authorized dealers in their own country. Quin reserves the right to not warrant helmets purchased from a country different from the customer's own country of residence, or helmets purchased in one country for use in another country, because regulatory standards or certification requirements for helmets vary from one country to the next. Helmets purchased from outside of the customer's own country may not have been designed with the the features and aspects intended for buyers in the customer's country that are important for making Quin helmets a world leader in premium motorcycle helmets and for providing the Quin experience. Quin, on behalf of itself and its dealers, disclaims any obligation to provide warranty service for helmets purchased outside of the country where the helmet is presented for warranty service.
Additionally, genuine Quin helmets should only be purchased from authorized dealers within your country of residence. Quin does not warranty helmets purchased from a country different from the one you reside and ride in. Regulatory standards and certification requirements for helmets vary from one country to the next, thus helmets purchased from outside your country may not have been designed with the features and safety standards intended for use in your region.
We offer an additional warranty period which covers against merchandise defects. To determine warranty requirements for a specific item, please contact Quin for assistance.
Please note warranty processing may take 4-8 weeks and will be subject to the Quin's policies and discretion. Quin warranties do not cover defects determined to be caused by normal wear or due to customer negligence.
Please let us know ASAP if any items on your order arrive damaged. Please keep all original shipping containers and take pictures if possible. Damaged item claims are handled through the shipping carrier (UPS, FedEx, USPS, OnTrac). We will assist our customers in these claims. We only ask that customers be patient as sometimes this process can take longer than any of us would like!
Quin Design is not responsible for any damage or loss of returned packages and we suggest that you insure the returned package(s) through the carrier. We cannot process exchanges on damaged items; damaged items will be returned to the customer via ground shipping.

Most of the helmets we sell will ship quickly and be at your door fast. We operate two distribution centers, one in the USA and one in India. Additionally, we work closely with our fulfilment partners in order to have the product shipped directly to you from their warehouse if that means you will get the product faster.
Helmets will have availability status shown once a size/color is selected on the product page; this availability status will also be shown on the shopping cart page and in your order confirmation email. Most products will be marked "In Stock - Ships Within 25-72 Hours". These products will typically ship same or next business day. The earlier in the day the order is placed, the better the chance it will ship that day.
While we will do our best to ship from the distribution center closest to you, naturally not all items will always be in stock in every location at all times. In some cases we will split the order and ship each package out to you individually and in other cases we may need to consolidate the items in one location to ship out as one package. We utilize our best judgment in an attempt to get the products to you as quickly as possible.
Some items will be marked "Available - expect 3-5 business days lead time prior to shipment". These items cannot ship same day and require lead time prior to shipment. If you select an expedited shipping method, please note that this will not reduce the lead time before the order is shipped!
A shipping confirmation email including carrier specific tracking information will typically be sent within 24 hours of an item shipping. For example, if you place an order Monday night and it ships out Tuesday morning, you will receive your tracking information either Tuesday evening or Wednesday morning.
Shipping Method Explanation
Business days are Monday-Friday; Holidays, Saturday and Sunday are not included in shipping days.
Fast Standard Shipping
Delivery typically in one to five business days.
Delivery by the end of the third business day after an order has shipped. For example, if an order is placed Tuesday night and is processed/shipped on Wednesday, it would arrive on Monday of the following week.
Delivery by the end of the second business day after an order has shipped. For example, if an order is shipped out on Monday, it will arrive on Wednesday. If the order is placed Monday night and ships out on Tuesday, it will arrive on Thursday.
Delivery the next business day after an order has shipped. An order that ships out on Thursday with Next-Day delivery would be delivered on Friday. An order shipping out on Friday with Next Day delivery would arrive on Monday.
Shipping changes after the order is shipped, such as intercepts, address change, and will call pick-up may be subject to a $10 Service fee per shipment (this is simply passing along the fee billed to us by the carrier to make the change when in-transit).
Once an order has been placed, it is final and cannot be cancelled. Quin will work with you to offer an exchange in model or size only as long as stocks permit.
International Shipping Terms & Conditions
Prices are shown in US dollars. For conversion, we recommend using a Currency Converter.
Any import duties, taxes or brokerage fees due at the time of delivery are the sole responsibility of the receiving customer. Packing slips for International Shipments cannot be marked as a "gift" or with altered prices.
International Orders may require 3-5 business days or more of additional processing time prior to shipment as we may need to consolidate items to one location for shipment.
When "Fast International Shipping" method is selected, orders will be shipped by a carrier of our choice (USPS, DHL, or UPS). Typical transit time will be 3-5 business days.
Some brands may not be shipped to certain destinations due to manufacturer restrictions. If you have selected an item that cannot be shipped internationally we will inform you in the checkout process on our site. If you are visiting the US we can ship any product to your hotel or any UPS store for pickup.
Returns / Exchanges
Customer is responsible for all back and forth shipping and brokerage charges for returns or exchanges.
International shipments should be marked as a "Merchandise Return" with a carrier that does not levy brokerage fees. Customer is responsible for any applicable brokerage or customs charges.
Any items shipped COD or having additional brokerage fees that are charged to Quin upon delivery will be rejected.
All other applicable conditions and terms of our Return & Refund Policy apply to international returns.
For warranty claims please contact Quin Design. While Quin will assist international customers with warranty claims, items may need to be shipped to the U.S. or India for inspection or repair. The customer will be responsible for these additional back and forth shipping charges.
